Terms of Use

These Terms of Use govern access to the Flopix platform and its use, whether free or paid. They are separate from the Terms of Sale, which govern the subscription to a plan, its price and its termination. The two documents apply together: the Terms of Use from account creation, the Terms of Sale from the first payment.

Article 1: Acceptance of the Terms of Use

Creating an account on Flopix requires prior and unreserved acceptance of these Terms of Use. This acceptance is collected through a checkbox at the time of registration, or through signing in with a Google, Facebook or Apple account, which constitutes acceptance in the same way. The date of this acceptance is retained.

Anyone who does not accept these Terms of Use must refrain from creating an account and from using the platform.

Article 2: Access to the platform and account creation

Registration is reserved for adult natural persons, acting on their own behalf or on behalf of a legal entity they are authorized to represent. A minor may not open an account.

The User undertakes to provide accurate information when registering and to keep it up to date, in particular their email address: it is the channel for account verification, invoices and important notifications regarding the published site.

An account is personal. The User is responsible for keeping their password confidential and for all actions carried out from their account. Any suspicious use must be reported without delay through the contact form. Flopix provides two-factor authentication, which the User is encouraged to enable from their security settings.

Article 3: Description of the features

Flopix lets you create a showcase website from a guided form, preview it, then publish it at an address provided by Flopix after subscribing to a plan. The platform also gives access to a dashboard, an affiliate program, a support ticket system and the management of billing information.

Before any payment, the created site remains viewable in preview for a limited period, protected by a password. After that period, the preview closes, and a site that is never paid for is automatically deleted at the end of the period indicated in the dashboard.

Flopix may change the features of the platform, add to them or remove them, in order to improve the service or to take account of technical and regulatory constraints.

Article 4: Content published by the User

The User is solely responsible for the content they upload to the platform: texts, photographs, logo, opening hours, contact details, links and the legal notice of their site. They warrant that they hold all the rights necessary over this content, in particular over the images and trademarks they publish.

By uploading content, the User grants Flopix a license strictly limited to hosting, displaying and backing up that content, for the needs of the service and for the duration of the contractual relationship. Flopix claims no ownership right over the User's content and does not use it for any other purpose.

In particular, illegal, misleading, defamatory, hateful or pornographic content is prohibited, as is content infringing the rights of third parties, along with content relating to regulated activities that the User is not authorized to carry out. The detailed list of prohibited content and uses is given in Article 10 of the Terms of Sale and forms an integral part of these Terms of Use.

The User remains responsible for complying with their own legal obligations toward their visitors and customers, in particular regarding legal notices, data protection and price information.

Article 5: Rules for using the platform

The User undertakes not to harm the operation of the platform or to misuse it. The following are in particular prohibited:

Article 6: Availability of the service

Flopix uses reasonable means to ensure the availability of the platform and of the published sites, without being able to guarantee uninterrupted operation. Interruptions may occur for maintenance, updates, or due to a third party provider, in particular the host or the payment provider.

The consequences of these interruptions on the paid subscription are dealt with in Article 8 of the Terms of Sale.

Article 7: Flopix's intellectual property

The platform, its graphic charter, its texts, its site templates, its source code and its trademark remain the exclusive property of Flopix. These Terms of Use transfer no intellectual property right to the User: they grant them a mere personal, non exclusive and non transferable right of use, for the duration of their account.

The ownership of the created site and the terms of its possible transfer are dealt with in Article 7 of the Terms of Sale.

Article 8: Personal data

The processing of the User's personal data is described in the privacy policy, which sets out the data collected, the purposes, the retention periods and the rights available to the User. Data deletion can be requested at any time, following the procedure described on the data deletion page.

Article 9: Account suspension and deletion

The User may delete their account at any time from their account area. This deletion ends access to the platform and leads to the deactivation of the associated sites, without refund of subscriptions already paid, under the conditions set out in Article 5 of the Terms of Sale.

Flopix may suspend or delete an account, as well as remove content or close a site, in the event of a breach of these Terms of Use, manifestly illegal content, fraud, or non payment. Except in an emergency or legal obligation, the User is informed and invited to remedy the situation before any final measure.

Article 10: Amendment of the Terms of Use

Flopix may amend these Terms of Use, in particular to take account of technical or regulatory changes. Users are informed of any substantial change by email or by information displayed on the platform. Continued use of the service after this information constitutes acceptance of the amended Terms of Use; failing that, the User may delete their account.

Article 11: Applicable law and disputes

These Terms of Use are governed by French law. In the event of a difficulty, the User is invited to contact Flopix via the contact form. The terms of mediation and dispute resolution, including referral to the consumer mediator, are detailed in Article 13 of the Terms of Sale and also apply to these Terms of Use.

The platform's publisher, its host and its contact details appear in the legal notice.
